As you may know, the HST New Housing Rebate is established and governed by the federal Excise Tax Act, and is aimed primarily at those who buy a new or substantially-renovated home from a builder.

    My wife and I purchased a newly built home in 2010. The house is in both names in Title and Purchase agreement. It was my wife`s first home purchase and my second. Do we qualify for the rebate which we never received. If so, will the time lapse be an issueÉ

    It is irrelevant for the purposes of determining whether or not you qualify for the HST rebate that one of you is a first-time home buyer or not. You're probably thinking of the Land Transfer Tax Rebate. For the HST rebate you need only be purchasing a new (or substantially renovated) home and both be living there as your primary residence.
